
Refaz Reconstrução (Decree 58.067/2025) will allow companies that owe ICMS to settle their debts with the State Revenue Service and the State Attorney General’s Office (PGE), with a reduction of up to 95% in interest and fines.
The initiative seeks to reduce a stock of R$55.2 billion in ICMS debts in the state. Currently, around 72% of this amount is in the judicial collection phase, with 60% of the total corresponding to interest and fines for late payment.
Membership of Refaz Reconstruction will be available from March 19, 2025 to April 30, 2025, offering two ways of settling ICMS debts: full settlement of debts or payment of specific debts.
If the taxpayer chooses to pay in full, they will have access to the biggest discounts:
- 95% discount for cash payment;
- 90% discount for installments of up to six installments.
On the other hand, taxpayers who prefer to select specific debts for settlement will receive discounts depending on the number of installments chosen:
- 75% discount for cash payment;
- 70% discount for installments up to 18 times.
For longer terms, the discounts will be progressively reduced:
- 50% discount for installments between 19 and 36 times;
- 30% discount for installments between 37 and 60 times;
- 10% discount for installments between 61 and 120 months.
There is also the possibility of scheduling an account debit, with the minimum amount for each installment being R$300.
Finally, Refaz Reconstruction does not allow for the offsetting of debts.
